Candids & Colors Service Contract
ALL Clients will sign this contract or a variation of at time of session
Candids & Colors Contract of Service
The client understands, respects, and agrees to Candids & Colors Photography Studio Policies.

The client understands and agrees to the COvid-19 liability release
​
The remaining balance must be paid in FULL at the time of the session unless a payment plan has been agreed upon prior to booking.
The client is responsible for reading all session preparation instructions and information listed on the website as well as what is sent in communication with Candids & Colors Photography, LLC.
The client is responsible for any and all permit fees that may be required for use of the session
location. Permit Fees are non-refundable in the event of cancellation
Session locations are to remain confidential, and questions regarding the location in the images are to
be directed to Candids & Colors Photography.
Session Fees are NON-REFUNDABLE once a session takes place.
The proofing gallery and 3 images are included with a MODEL call.
Images included with paid sessions are listed on invoices as well as session descriptions. Please refer to the session description viewed prior to booking.
Additional digital images are available for purchase at $25/image.
Images are for clients' personal use only. Images shared on social media MUST be
watermarked and/or credit is given to Candids & Colors Photography.
Proofing Galleries are delivered in 3-10 BUSINESS Days (Business Days do not include weekends, holidays, or travel) after the session. Proofing Galleries are active for 1 month, after one month the gallery will expire. Proofing Gallery can be reopened for 2 weeks with an activation fee of $50 for every time the gallery is reopened.
The client is responsible for notifying the Photographer's assistant of final image selections. Final digital edits are delivered 10-30 BUSINESS days (Business Days do not include weekends, holidays, or travel) through an online gallery after the CLIENT notifies the photographer of the final image selection.
Delivery dates are pushed back for emergencies, business trips, and holidays. Please note all trips are posted in advance on Candids & Colors Photography's Instagram and Facebook page. It is understood to follow the Candids & Colors Photography Instagram and Facebook page for all business updates.
Delivery can be expedited with RUSH FEE ($250)
Images chosen 2 months or longer after the session can take 3 months or longer for final delivery.

Mpix.com is the suggested lab for color accurate printing. We cannot guarantee color accuracy at
Walgreens, Target, Walmart, Costco, Sam's Club, etc.
The photographer is not responsible for uncooperative children or adults during a session.
There will be no refunds or reshooting due to cosmetic issues i.e. Unhappy with facial expression, clothing choice, makeup flaws, scabbing, location choice, etc. Only the photographer reserves the right to offer a reshoot.
Photographer only guarantees file storage for up to one year.
The signing of this contract RELEASES photographer and assistants of ANY AND ALL
LIABILITY.
Understanding of photo use
It is understood that Candids & Colors Photography reserves the right to use negatives,
RAW images, edited images, and/or reproductions for advertising, display, publications or
other purposes not restricted to the web, Facebook, business cards, or posters.
No part of any order including previews will be delivered until the balance is paid in full.
RAW unedited images are NOT INCLUDED, ONLY specified session-edited images are included in the purchase package(s) and any additional images purchased. RAW images are available for purchase for $1500. Client can purchase raw images within 6 months of the session.
The photographer retains the right to edit images and omit any image. It is understood that the
the photographer will not deliver every exposure taken.
The client agrees to abide by the photographer's editing decisions. Excessive editing requests for makeup imperfections, blemishes, flaws/wrinkling in clothing not provided by the studio, etc... are not guaranteed.

The client understands that images are sized to the standard 4x6 ratio. The client also understands that Any prints outside of the 4x6 ratio will alter the image and the photographer is not responsible for cropping outside of the standard 4x6 ratio
(4x6 Ratio means prints of; 4x6 | 8x12 | 12 x 18 | 16 x 24 | etc...).

Photographer does not release any/all unedited and/or RAW images unless purchased for $1500. Only edited images are delivered.
The client will receive photos through digital downloads with print release for PERSONAL use ONLY. Digital
download includes high-resolution images sized for 4x6 ratio printing and watermarked web-optimized images for use on
social media. The client may not edit photos in any way unless RAW images are purchased. When the client publishes
images all images must be watermarked and credit is given to Candids & Colors Photography.
For Consideration herein acknowledged as received, and by signing this release I hereby
give the Photographer my permission to license the Content and to
use the Content in any Media for any purpose (except pornographic or defamatory) which
may include, among others, advertising, promotion, marketing, and packaging for any
product or service. I agree that the Content may be combined with other images, text,
graphics, film, audio, and audio-visual works; and may be cropped, altered, or modified.
I agree that I have no rights to the Content, and all rights to the Content belong to the
Photographer. I acknowledge and agree that I have no further right
to additional consideration or accounting and that I will make no further claim for any reason
to Photographer. I acknowledge and agree that this release is
binding upon my heirs and assigns. I agree that this release is irrevocable, worldwide, and
perpetual.
It is agreed that my personal information will not be made publicly available but may only be
used directly in relation to the licensing of the Content where necessary (e.g. to defend
claims, protect rights, or notify trade unions) and may be retained as long as necessary to
fulfill this purpose, including by being shared with sub-licensees / assignees of the
Photographer / Filmmaker and transferred to countries with differing data protection and
privacy laws where it may be stored, accessed, and used. I represent and warrant that I am
at least 18 years of age and have the full legal capacity to execute this release.
Definitions: “ASSIGNS” means a person or any company to whom Photographer/Filmmaker
has assigned or licensed rights under this release as well as the licensees of any such
person or company. “CONSIDERATION” means $1 or something else of value I have
received in exchange for the rights granted by me in this release. “CONTENT” means all
photographs, film, audio, or other recordings, still or moving, taken of me as part of the Shoot.
“MEDIA” means all media including digital, electronic, print, television, film, the radio and other
media now known or to be invented. “MODEL” means me and includes my appearance,
likeness, and voice. “PARENT” means the parent and/or legal guardian of the Model. Parent
and Model are referred to together as “I” and “me” in this release, as the context dictates.
“PHOTOGRAPHER / FILMMAKER” means photographer, illustrator, filmmaker or
cinematographer, or any other person or entity photographing or recording me. “SHOOT”
means the photographic, film or recording session described in this form.
